You agree to notify us immediately of any unauthorized use of your account.

5. Vendor Obligations

Vendors using Zynda agree to:

  • Fulfill orders in a timely and professional manner

  • Comply with applicable laws and regulations

  • Maintain clear, respectful communication with customers

Zynda may monitor interactions and reserves the right to take corrective action in the event of disputes or non-compliance.

6. Fees and Payments

Zynda may charge transaction, listing, or subscription fees for use of specific services. All fees are communicated transparently. You agree to pay all applicable charges incurred through your use of the Platform. Payments are processed through secure third-party providers, and you agree to comply with their terms of service. Zynda is not responsible for errors or issues resulting from third-party payment systems.

7. Prohibited Activities

Users and vendors are prohibited from:

  • Violating any laws or regulations

  • Engaging in fraudulent, deceptive, or abusive practices

  • Infringing on intellectual property rights

  • Transmitting viruses, malware, or harmful code

  • Interfering with the operation or security of the Platform

Zynda reserves the right to investigate and take legal or administrative action for violations.

8. User Content

Users and vendors may submit content, including text, images, listings, reviews, and messages. By submitting content, you grant Zynda a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute such content on the Platform. You represent that you have the rights to submit the content and that it does not violate any third-party rights or laws.

9. Intellectual Property

All content and materials on Zynda, including but not limited to logos, text, software, and design, are the property of Zynda or its licensors. You may not reproduce, modify, or distribute any content without express permission. All trademarks, service marks, and logos displayed are the property of their respective owners.

10. Privacy

11. Termination

Zynda may terminate or suspend your account and access to the Platform at our discretion, without notice, if you breach these Terms or engage in conduct that is harmful to the Platform, other users, or third parties. Zynda disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Zynda shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or data, arising out of your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to us in the six months preceding the claim.

14. Indemnification

You agree to indemnify and hold Zynda, its affiliates, officers, agents, and employees harmless from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another.

15. Modifications to Terms

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of Johannesburg, South Africa.
